By Mr. Sandeep Kumar Jain , E-mail :jeevdaya@rediffmail.com The railway orders for restarting transport of cattle has been issued after distorting many sections of Act & Rules.Transport of Animals Rules under Sec 96 state: TRANSPORT OF ANIMALS(AMENDMENT) RULES, 2001 S.O.269 (E) - Whereas certain draft rules further to amend the Transport of Animals Rules, 1978 were published as required by sub-section (1) of section 38 of the Prevention of Cruelty to Animals Act, 1960 (59 of 1960) under the notification of the Government of India in the Ministry of Social Justice & Empowerment number S.O. 1164 (E) dated 26th December 2000 in the Gazette of India. Extraordinary, Part II, Section 3. Sub Section (ii) dated the 27th December, 2000 inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of the period of sixty days from the date on which copies of the Gazette containing the said notification are made available to the public.
And, whereas copies of the said Gazette were made available to the public on the 1st January 2001. Now, therefore in exercise of the powers conferred by sub-section (1) and (2) of section 38 of the Prevention of Cruelty to Animals Act 1960 (59 of 1960), the Central Government hereby makes the following rules further to amend the Transport of Animals Rules 1978, namely - (1) These rules may be called the Transport of Animals (Amendment) Rules, 2001.
96. Issue of certificate before transportation -
(2) In the absence of such certificate, the carrier shall refuse to accept the consignment for transport.
97. Cancellation of permit or authorisation for transport-
(2) The custody of the animals immediately after unloading from the rail wagons, truck or any other vehicle shall be given to the authorised Animal Welfare Organisation if available, till the competent authority or the magistrate having jurisdiction decides about their care and upkeep. (1) Animals to be transported shall be healthy and in good condition and such animals shall be examined by a veterinary doctor for freedom from infectious diseases and their fitness to undertake the journey; provided that the nature and duration of the proposed journey shall be taken into account while deciding upon the degree of fitness. (2) An animal which is unfit for transport shall not be transported and the animals who are new born, diseased, blind emaciated, lame, fatigued or having given birth during the preceding seventy two hours or likely to give birth during transport shall not be transported.
(3) Pregnant and very young animals shall not be mixed with other animals during transport. But in orders by Railway Board issued on14.7.2004
- Similarly ,as per AWBI's recommendation that AWBI and its representative must be informed well in advance about movement of cattle by trains,its route and details of consignor and consignee,stoppage etc.the Railway Board seems to be in hurry so it has reduced the timelimit to one day,to help the Cattle traders without caring for Rles and Laws passed by the Parliament. -------------------------------------------
